The Service provided by Metaome is free of cost. However, Metaome reserves the right to charge for its future usage without any prior intimation. If you are a Registered User, Metaome may provide a reasonable prior notice of chargeability of Service(s).

You may access Metaome for any information on life sciences. Metaome assumes no responsibility over ownership of any information available on Metaome. Further, Metaome is in no way liable for accurateness, correctness, originality and/or genuineness of the information generated on its site.

Metaomes absolves itself over any liability or responsibility that may arise in connection with your usage with such third party web links. You understand that all information generated through Metaome, to which You may have access are the sole responsibility of the person from which such information originated. Metaome hereby claims no responsibility over such information. You further acknowledge that Services provided by us including but not limited to information, news, articles, video clips, images, pdf files and so on (herein after collectively referred to as “Contents”) may be protected by Intellectual Property Rights, that may be owned by a third person. By registering with Metaome, You agree not to alter, modify, amend, distort, change, create derivative works or in any manner deal with such Content that may result in violation of Intellectual Property Rights of such third person. Metaome shall not be held liable for any damages and or losses suffered by any person as a result of any usage of the Services either by such person himself or by any third Party.

You agree that the Content and Web Site are protected by copyrights, trademarks, patents or other proprietary rights and laws Except as expressly provided in these Terms of Use, nothing contained herein shall be construed as conferring any license or right, or transfer of any Intellectual Property to You.

In order to access Metaome, You may have to register Your name and details with us. In consideration for Your usage You will have to provide true, accurate and correct information in the Registration Form provided by Metaome. Should Metaome reasonably suspect that the information provided by You is incorrect, inaccurate or not genuine, it has all rights to suspend or with hold registration without any notice and/or liability to You.

Upon registering with Metaome, You will be provided with user id and password, which can be used by You for accessing Metaome. It is Your responsibility to maintain confidentiality of Your password. Metaome assumes no liability for any or all activities that may occur under Your account. You agree to notify Metaome of any unauthorized use of Your user id or Password. Metaome shall not be responsible for any damage or losses that may arise as a result of Your failure to comply with this Clause. By submitting Your contributions to Metaome You acknowledge that: a. your Contributions do not contain confidential or proprietary information or violate any third party Intellectual Property; b. You are not entitled to receive any returns for Your contribution c. Your contribution does not contain any obscene or scandalous content.

Metaome reserves the right to modify, alter or amend the contents contributed by You as it may deem fit. You are solely responsible for any Content that You upload in Metaome. Under no circumstances will Metaome be liable in any way for any Content, including, but not limited to, any exposure to offensive, indecent or objectionable Content, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via Metaome.

You agree that you will not engage in any activity that interferes with or disrupts the Services provided by Metaome. You agree that you are solely responsible for and that Metaome has no responsibility to you or to any third party for any breach of your obligations under the Terms and for the consequences (including any loss or damage which Metaome may suffer) of any such breach.

You agree not to use Metaome’s Services to: a. Transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, obscene, libelous, invasive of another's privacy, and or contrary to general public interest, b. Transmit any content, upload, post or any other mode, which You are not authorized to transfer or manipulate with under any applicable law or under any contractual obligation. c. carry out any activity that may be designed to interrupt or limit the functionality of any software or hardware and or result in the transmission of software viruses

You agree to indemnify and hold Metaome harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of Content you submit, post to or transmit or make available through the Service, your use of the Service, your use of any Medium, your breach of Terms, or your violation of any rights of any other person, or your breach of any applicable law.

You shall be bound by the Terms unless You choose to terminate the Services by closing Your accounts for all the Services provided by Metaome

12.1 Notwithstanding any other provision set forth herein, Metaome shall not be liable for any indirect, special, and/or consequential damages, arising out of or in connection with the Service(s)

12.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL METAOME BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, FOR LOSS OF PRIVACY, FOR FAILURE TO MEET ANY DUTY INCLUDING OF GOOD FAITH OR OF REASONABLE CARE, FOR NEGLIGENCE, AND FOR ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SERVICE OR USE OF THE SUCH SERVICE(S) IN A MANNER AND FOR A PURPOSE OTHER THAN THOSE FOR WHICH THE LICENSE IS GRANTED, ANY LOSS OR DAMAGE ARISING OUT OF OR IN RELATION TO ACT OF GOD OR ACT OF THIRD PARTY THAT IS BEYOND THE CONTROL METAOME.

13.1 Not withstanding the location of the User, the construction of this Terms and Conditions shall be determined in accordance with the Indian Contract Act, 1872 and other laws in force in India and shall be subject to the exclusive jurisdiction of the Courts in Bangalore.

13.2 All disputes arising under or in relation to this Agreement may be referred to arbitration before a sole arbitrator. If the Parties fail to agree on the appointment of a sole arbitrator within the time stipulated under the [Indian] Arbitration and Conciliation Act, 1996 (the “Act”) the Parties shall approach the competent Court under the Act for appointment of the Sole Arbitrator. The Arbitration proceedings shall be carried out in accordance with the Act and the Rules framed there under and the place of Arbitration shall be______. The arbitration proceedings shall be conducted in English.

If any provision of these Terms is deemed unlawful, void, or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.

Terms may be updated, modified or amended from time to time by Metaome without notice providing any prior notice to You.
